Documentation of Disability and Maintenance and Confidentiality of Medical Records

 

If a qualified individual with a disability seeks an accommodation, the individual must be referred to the Disability Resource Center for disability and accommodation review. The individual must provide appropriate and sufficient documentation to verify the disability and the need for an accommodation; and must request such accommodation. The individual with a disability must participate in the interactive process to identify appropriate accommodations.

The Disability Resource Center generally will be the custodian of records for students’ medical records obtained for the purpose of documenting disability and providing accommodations; the Campus Health Service Occupational Health Clinic and/or the Disability Resource Center will be the custodian of records for employee’s medical records obtained for the same purposes. University administrators or departments will transfer all employees’ or students’ medical records they receive to the Disability Resource Center, which will make a determination regarding who should maintain those records.

Disability and medical information is confidential and will not be shared except where disclosure is required by law or is necessary to facilitate legitimate University processes, including granting appropriate accommodations, addressing direct threats or investigating claims or charges.
